These Terms and Conditions (“Terms”) govern your access to and use of the website and online store operated by Josie’s Best Gluten Free Mixes, LLC, an Oregon limited liability company (“JBGF,” “us,” “our,” or “we”). By accessing or using our website (the “Site”) or purchasing any products from us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or purchase our products.
These Terms should be read together with our Privacy Policy.
1. Children
Our Products are not directed to individuals under the age of 13, and we do not knowingly collect personally identifiable information from children under age 13. If you are under age 13, you are not authorized to use or access our Products. If we discover that we have received any personal information from a child under the age of 13, we will delete that information immediately. If you believe we have any information from or about anyone under age 13, please contact us at the address listed below.
2. Our Products
JBGF sells gluten-free baking mixes and related products. We make every effort to accurately display product information, ingredients, and images. However, we do not guarantee that product descriptions, colors, or other content on the Site are completely accurate, complete, reliable, or error-free. Actual product packaging and materials may contain more or different information than what is shown on the Site.
3. Orders and Payment
All orders placed through the Site are subject to product availability and our acceptance. We reserve the right to refuse or cancel any order for any reason, including pricing errors, product availability, or suspected fraud.
Prices are listed in U.S. dollars and do not include applicable taxes or shipping costs, which will be added at checkout where applicable. Payment is processed by third-party payment providers. We do not store your full credit card information.
4. Shipping
Shipping times and costs are estimates only. We are not responsible for delays caused by carriers, customs, weather, or other factors outside our reasonable control. Risk of loss and title for products pass to you upon delivery to the carrier.
5. Returns and Refunds
Returns will only be accepted on unopened products.
Before returning any product, email hello@josiebestgf.com for a Return Authorization Number. Returns will not be accepted without a Return Authorization Number. Returns must be made within 2 weeks of receipt. Exchanges and returns are shipped at the customer’s expense. Returns should be sent by Secure Mail so they may be tracked. We are not responsible for returns lost in transit or otherwise not delivered to us.
Returns that adhere to our Return Policy will be refunded the purchase price, minus shipping, once the product is received and inspected.
6. Intellectual Property
All content on the Site — including text, graphics, logos, images, product descriptions, and software — is the property of JBGF or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission.
7. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. JBGF DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JBGF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE OR PRODUCTS; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR INFORMATION.
IN NO EVENT SHALL JBGF’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE SITE OR PRODUCTS EXCEED THE AMOUNT YOU PAID TO JBGF IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to defend, indemnify, and hold harmless JBGF and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any third-party right.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Deschutes County, Oregon, and you hereby consent to the personal jurisdiction and venue therein.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make changes, we will post the updated Terms on this page and update the “Last Updated” date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
